Transcript of interview with Senate President Manny Villar over ANC with Ricky Carandang

Q: How was the discussion because I was talking to Mar Roxas yesterday morning. He was saying that it looks like you all agreed na wag na lang tanggapin itong compromise?

SPMBV: Actually parang napagkaisahan naman namin sa Senado at nagkasundo -sundo kami sa bandang huli na huwag nang tanggapin ang compromise.

Q: I think the fact that none of the Senators is saying "ah we don't agree " proved that the decision was actually a good faith unanimous decision. But what were the factors that led to that, kasi earlier some of the senators are open to the idea of compromise?

SPMBV: Well, binabalanse kasi namin yung short term advantage and baka sakali, mapasalita namin si Secretary Neri. Posibleng maging precedent yan and sa amin, sa akin, at sa Senado mismo. Mahalaga yung institusyon. It is no longer about Sec. Neri , this is about the Senate as an institution. Mahalaga na yung aming tungkulin na nakasaad sa konstitusyon ay hindi namin mai-compromise. Baka kasi balikan kami in the future, maski wala na kami lahat dyan, baka yung mga future senators magka-problema ditto. Dahil baka magamit na precedent itong nangyari na agreement namin dito sa Supreme Court. Particularly now, maliwanag naman sa isipan namin yung aming ginagawa ngayon na talagang hinahanap lang namin ang katotohanan, nag-iimbestiga kami at sa aming palagay talaga maliwanag naman yung aming mandate sa konstitusyon. Para sa amin, mabuting ito ay liwanagin ng Supreme Court kasama na yung limitasyon ng karapatan ng Executive Department sa paggamit at pag-invoke ng executive privilege. Marami pang imbestigasyon na darating hindi lamang ang ZTE, tulad ng inquiries sa Northrail, Southrail, Spratly Island, at yung bago ngayon yung sa smuggling sa Customs at marami pang iba, na kailangan kami ay guided in our investigations in aid of legislation.

Q: Pero Sir, kahit tinanggap ng Senado yung compromise proposal, babalik din naman sa Supreme Court itong issue ng executive privilege?

SPMBV: Yun na nga. Actually pag tiningnan mo hindi rin magsasalita si Sec. Neri. Mag-i-invoke parati yun ng executive privilege. To me, mahalaga dito yung collective decision ng Senado. Kagabi, ang iniisip naming ay hindi lang si Sec. Neri, hindi lang yung ZTE, kung hindi the Senate itself as an institution. Naniniwala kami na pinakamahalaga yan.

Q: Sir, your talking about Senate precedent. Sabi niyo nga pag tinanggap ninyo ito magiging precedent ito para sa mga susunod na Senado. Lets talk about that a little bit, because before Executive Order 464, when the Senate summoned someone, they will go. After 464, there seems to be a blanket prohibition that they need to get permission first.

SPMBV: Magpapaalam muna sila sa Pangulo or sa Executive Secretary bago makapunta sa legislative inquiries.

Q: Pero ngayong parang nasira na yun. Parang now people feel free to leave the country when they are summoned, they get sick or one way or the other?

SPMBV: Actually, the point is that nakita natin kay Mr. Lozada na isang di naman ganun kataas ang posisyon sa government, nakita natin yung nangyaring pagpipigil sa kanya na makapagsalita, no less than 2 or 3 cabinet members called him, tapos yung involvement ng airport officials , even yung PSG dumating at yung sa PNP. Tatlong grupo ng pulis, sa testimonya ni Lozada, ang nagkidnap sa kanya. So makikita mo talaga yung efforts to stop him from testifying before the Senate. Parang nakikita ko talaga rito ang laki ang laki ng effort: pinadala siya sa HongKong, papadala siya dapat sa London yung efforts talaga to stop an official from testifying before the Senate. Nakita natin kay Mr. Lozada, incredible ang ginamit na government resources. Sa akin talaga makikita mo dyan yung talagang ayaw ng gobyerno natin na magsalita yung officials nila lalong-lalo na pag may anomalya. Marami naman kaming investigation na hindi kontrobersyal at dumarating sila. Pag lang may anomalya, pag yung imbestigasyon is about an anomaly, bigla nakikita mo yung concerted effort not to participate.

Ricky: Pero pag sa budget at CA dumadarating sila?

SPMBV: Totoo iyan. Nandun sila. Yung sa Ayala Glorietta bombing, nandun naman sila . Nandun yung mga pulis at talagang in-argue nila yung case nila. Pero pag may anomaly, makikita mo talaga ang grabeng efforts to stop an officials from telling us what they know.

Q: So, it is in that context that they stop people from attending the hearings, that nobody seems to feel comfortable attending the hearings in the Senate anymore. With the Senate saying no to the compromise, do we assure the authority of the institution then?

SPMBV: Sa amin mahalaga talaga yun. Mahalaga ito sa panahong binabalewala ng Executive yung Senate at House. Even the power of the purse, kinuha na ng pangulo yan. Kung kami ay papayag ngayon sa compromise na ito, baka paliit ng paliit, pausog-ng pausog, ang legislative power and after a while magising na lang kami na pati ang Senado ay wala na din. At talagang pangangatawanan naman namin ito dahil ito ang kailangan at nakatalaga sa konstitutusyon. At ito ay tahasan kong sasabihin, for as long I am the President of the Senate, the Senate will be independent.

Q: Sir, do you believe that the Chief Justice made that proposal in good faith?

SPMBV: OO naman.

Q: Saka nakikita ko naman yung punto ninyo na it is time for the Senate to reassert itself in this matter. But have you given any thought as regards how this issue will possibly proceed or even spinned by people who are critical of the Senate at pwedeng sabihin nila "o, eto na nga nagmi-middle ground ang Supreme Court and ang Senado ngayon--- ang yabang at ayaw pang pumayag," I mean are you worried that it could be spinned in that way?

SPMBV: To me and to us very strong ang aming belief that we are on the right track. Ang paniniwala ko naman, ito ang aming tungkulin. Naghahanap lang kami ng katotohanan. Yung halimbawa, pinatawag namin yung mga pulis, labing pito silang lahat na issued with subpoenas, at wala lahat dumating, paano naman maliliwanagan yung kidnapping issue doon. Ginagawa namang balewala itong napakahalagang inquiry ng Senado. Somehow we have to be careful also sa mga compromises na ito , kasi napupuna namin na pag napayag ka, usog ng usog ito. Kontrolado na nila ang maraming institusyon and nagwo-worry nga ang iba nating mga kababayan na baka daw ang Supreme Court after a while, pagkatapos na karamihan sa kanila ay ma-appoint ng pangulo ay magbago. Although, let me stress that the Judiciary is one institution that I will always respect and their independence, I will always consider. At sa parte ng Senado, kami naman ay elected ng tao, that we will continuously fight for what is right and for the truth.

Q: Does that mean that the Senate will be more aggressive and will issue more contempt orders kapag patuloy pa rin silang hindi pumunta sa Senado?

SPMBV: Kami talaga we follow the process we set. Maingat na maingat ako sa pagpirma. In fact yung arrest order kay Sec. Neri, I made sure na majority ng Senador ay nakapirma ditto. I told the chairman. Sen. Alan Cayateno, that if you don't have enough number comprising the majority, I will not sign the arrest order. Pero para dito, nakakuha ng majority na bilang ng Senador, and thus, I signed it.

Let me state that we follow a procedure. Nag-iimbita muna kami, pagkatapos subpoena and then we will ask them to show cause kung bakit hindi sila kailangan arestuhin, before we issue the arrest order. Ayaw naming gamitin iyan. Iyan ay last resort lang pag talagang harap-harapan na yung ginagawang pagbabalewala sa Senado.

Q: There's a pending arrest order to Sec. Neri, but if the Palace decide to send Sec. Neri in the hearing kahit di pa naresolba yan, will you lift the arrest order?

SPMBV: Actually, the effect of Secretary Neri's attendance is lifting the arrest order. If he decides and if Malacanan decides to permit him and attend, then the arrest order is no longer effective.

Q: what is the value of lifting EO 464? Some Senators said that it really doesn't mean that much anyway.

SPMBV: Immaterial na yung EO 464 o MC 108. Wala yan sa number, tingnan na lang natin yung sinseridad ng Pangulo. Sa tingin ko pag inutos ng Pangulo sa mga cabinet members, sa mga pulis, sa mga airport officials at sa lahat ng nasa gobyerno na pinapatawag ng Senado, na wag na kayo gagamit ng executive privilege, dahil napagbibintangan tayo sa pagtatakip at pagsisinungaling, kapag yun ang ginawa ng Pangulo, then dun lang ako maniniwala na sincere ang Presidente sa bagay na ito.

Q: Just to clarify you do believe that there are valid instances where Executive privilege could be invoked. Hindi naman po kayo nagsasabi na there is no such thing as Executive privilege?

SPMBV: Mayron naming executive privilege and that is mandated under the Constitution. Pero ang executive privilege, hindi nagagamit yan to cover-up a crime. Like ito, merong allegation of graft and corruption. hindi mo magagamit yan. Pangalawa, kapag national security ang na-invoke, dapat naman may military component. Hindi naman kasama dito ang DND sa ZTE deal. Kung merong national security risk, Im sure dapat na sa negosasyon, sinama na nila ang DND. At kung may diplomatic concern naman ito, dapat kasama ang DFA, hindi naman kasama ang DFA sa negotiation. Maliwanag na ngayon lamang nilalabas ang mga excuses na ito para magamit ang Executive privilege.

Q: Sir can we invoke Executive privilege when you ask questions about ZTE because they will say that the deal is connected to Spratly deal. Baka magkaroon ng diplomatic row kapag patuloy na iimbestigahan ito?

SPMBV: Dapat ma-investigate din yan. Initially, hindi naman namin matatanggap kasi yan. Sa Spratly issue, talaga namang dapat ipaliwanag ng Pangulo kung ano yung mga binigay nating concessions sa China. May mga allegations that umalis tayo sa ranks ng ASEAN para ditto. Normally ang ASEAN ang nag nenegotiate sa China, pero tayo ang nagsarili ng deal sa China. Siyempre nakakahiya sa mga kasama natin sa ASEAN yung ginawa natin. We have to look into the allegation on Spratly Island because its very serious. In fact, dapat sa halip na mahiya tayo sa China sa imbestigasyon natin dapat mahiya tayo sa mga kasamahan natin sa ASEAN kasi iniwan natin sila.

Q: So when will that investigation begin?

SPMBV: Meron nang resolusyon diyan. Mabigat ngayon ang trabaho namin sa Senado lalo na ang Blue ribbon committee talagang medyo napapaiyak na ang mga staff doon. end
