Interview with Sen. Miriam Defensor Santiago
after the Economic Affairs hearing

The purpose of this hearing by the Economic Affairs Committee is to ensure observance by the possible candidates in the coming elections of the prohibition in our Constitution that even if the funds are discretionary, they must be used for a public purpose. The operative term here is, is it public purpose to engage in personal premature campaigning using illegal public funds?

Kasasabi lang ng department of DBM na meron pala silang tinatawg na budget call na libro na hindi naming nakikita sa Kongreso pero ang nakikita naming budget e yung makapal. Nakalagay lang doon na ang bawat departemento ay mayroong maintenance, operating, and other expenses. Kaya akala ko tinatago ng mga kalihim o sekretaryo ng departemento ang gastos sa mga infomercial sa ilalim nitong operating expenses. Hindi pala! Meron pala silang panibagong libro na hindi binibigay sa amin na ini-itemize kung paano gagastusin ang miscellaneous and other operating expenses--at kasama pala doon ang advertising expenses! Kaya nagtaas ang kilay namin. Merong budget talaga para sa advertising expenses. Biro mo, malalaki pala ang mga budget nila. Nagyon ko lang nalaman na para sa advertising na--

Pagcor-P82M appropriation. Ang sinasabi ng chairman ay, "Kami naman ang kumikita niyan, hindi naman namin kinuha sa kaban ng bayan." Pero maski na, yun yung obligasyon nila--na kumita sila ng pera para pumunta sa kaban ng bayan. Department of Health- 32.4M for advertising. Tesda- P82M din. Kamukha nung sa Pagcor. Pagcor at Tesda ang mga valedictorian sa gastusan para sa advertising. Makati City-24M. DepEd- 5.7 MMDA 5.8 Dito sa Pagibig fund, kakaiba ito. Dahil ang binigay sa atin ay 2007 to 2009 up to the present. Si Vice President De Castro mismo ang nagbigay, Pagibig spent P172M. So malaki pala ang ginagastos sa advertising, lalo na ng Pagibig, Tesda, at Pagcor.

After that, I will file a committee report recommending that any department head, who personally appears in any commercial on television for his department allegedly should be sued or prosecuted in the office of the ombudsman and thereafter, if found guilty, should be disqualified from either running for public office or from holding the public office if he wins in the elections.

Kasi, nakalagay sa ating Constitution that equal opportunities to access for public service shall be observed by the government. In other words, dapat pantay-pantay kayong lahat. Huwag kang manguna sa mga kasamahan mo. Hindi naman fair yun, lalo na pera ng gobyerno ginagamit mo. Obligasyon ng mga cabinet members, dahil baka hindi sila abogado o baka magkamali sila, dhil sa budget pala e merong ganung appropriation for advertisement, e di dapat, ngayon na naturuan sila, sundin na nila ang batas. Kung ayaw nila, e di ipaimbestiga natin sila sa Ombudsman.

Maliban diyan, dapat kami naman nasa Kongreso, baguhin na ang Omnibus Election Code. Dahil palagi nalang ginagamit nilang excuse na ayon sa Election Code, hindi ka naman kandidato hanggang hindi ka pa nagfifile ng certificate of candidacy mo. Pero ilang beses ko ng ipinaliwanag na may section 80 sa Election Code na nakalagay, hindi kelangan na botante ka, hindi kelangan na kandidato ka, maski ano kang tao, hindi ka puwedeng magpremature campaign. Kaya masasabi na merong conflict ang ating Election Code.

Bakit yung interpretation na hindi na-aayon sa public interest ang inadopt ng ating Comelec? Kung may conflict talaga, bakit hindi nila sabihin, we resolve the conflict and we rule that section 80 will prevail, na maski anong tao na magfile ng certificate of candidacy mo o hindi, kandidato ka man o hindi, botante ka man o hindi, e hindi puwede magpremature campaign! E di tapos na ang lahat! Maliban diyan, dahil vice chair ako ng finance committee, sisiguraduhin ko na papalitan namin ang budget na gagawin para sa susunod na taon para matanggal na yung advertising expenses o malagyan man lang ng guidelines na kung ikaw ang ulo ng departamento, hindi ka dapat lumitaw diyan dahil wala naman nagsabi sa'yo na natutuwa sila sa mukha mo.

On senators who did not attend

Disappointing naman kasi ito ang hot potato e. Ayaw nilang pumunta kasi mamaya sila rin ay mapagbintangan din ng mismong krimen o election offense na iyon. Kaya makikita mo, ayon sa kasabihan sa korte, "He who comes to court, must come to court with clean hands." Kelangan kung magdemanda ka sa korte, malinis ang kamay mo. So you cannot say post hoc, after hoc. You cannot say, after me so therefore I caused whatever happened later. That statement by the Vice president is his assertion. It needs assessment.

Will you hold a second hearing?

I will have to evaluate each one (of the excuse slips), whether I find their excuse slips meritorious or not, I will just have them all subpoenaed para may disciplinary power ako kasi ganyan ang aming SOP dito e.
