Transcript of interview with the Majority Leader

On C-5 issue:

SJMZ: Ngayong hapon plano ko mag-3rd reading muna kami ng mga bills na very important measures at pagkatapos noon uumpisahan po natin ulit iyong debate sa C-5. Ang plano po ay mauna si Sen. Jinggoy Estrada na mag-interpolate kay Manong Johnny, the Senate President, after which i-interpolate naman ng minority si Senate President Enrile. Pagkatapos ng interpolation nila baliktarin po natin iyong bola, ipapasa po natin ang bola sa minority, sila po ang magi-sponsor headed by Sen. Cayetano, ang unang mag- interpolate si Sen. Jamby Madrigal. Basta ang importanteng pinag-usapan namin kanina at kahapon wala magbibitaw ng unparliamentary remarks, dahil kung meron magbibitaw ng unparliamentary remarks kaagad-agad ako ay tatayo wa-warningan ko po sila as Majority leader, and i would move to strike those unparliamentary words off the record. Kailangan meron na po tayong strict guidelines para hindi naman tayo magmukhang palengke at mapapahiya po iyong institusyon ng Senado sa mata ng taong bayan.

Q: Pero sabi ni Sen. Gordon, nagre-reklamo siya dahil gusto niyang talakayin muna sa floor iyong kanyang committee report kaugnay sa ZTE at Fertilizer scam?

SJMZ: Puwede naman. Nasa agenda naman po iyan at papagusapan din po natin iyan. Kahapon lang hindi lang natin natapos dahil ang gusto ni Sen. Pimentel ang ating Senate Minority Leader na, at least majority of the members of the Senate nandoon para pagbotohan ang panukalang resolusyon ni Sen. Gordon.

Q: i-accomodate pa rin ...

SJMZ: Yes. It will be an action pact day today. Pero uunahin ko muna itong mga bills for third reading and for ratification.

Q: Nag-caucus na ba kayo for ground rules sa botohan?

SJMZ: Wala pa. Wala kaming time for caucus kasi lahat po kami busy sa bicameral conference committees. Katulad nito katatapos ko lang ng isa babalik uli ako sa Immigration Bicameral Conference Committee Report.

Q: So, nagkasundo na doon sa botohan kung 12 or majority of the quorum or 2/3?

SJMZ: Hindi pa e.

Q: Pero kayo as majority leader anong ipu-push niyong ano ba talaga?

SJMZ: Well, i will listen to the consensus. Alam mo mahirap ng magsalita kasi kung magbibigay po ako ng personal opinion at the end of the day dito rin ang bagsakan niya sa plenary. It will be the collective decision of the Senate kung ano ba talaga? Twelve ba ang kailangan para ma-censure at ma-reprimand ang senador o desi sais?

Q: Or majority of the quorum?

SJMZ: No. I'm very sure na kung punishment of a senator hindi naman puwedeng majority of the quorum. Puwedeng ito lamang, let's say 12 kami diyan sa plenary tapos 7 lamang ang kailangan natin. Hindi naman puwede iyon. I think hindi po fair para sa ating mga senador na pitong boto lamang ng mga tao sa plenary para maparusahan sila.

Q: Sabi ni Sen. Enrile na kapag gumagawa ng business ang senado dapat may quorum ...

SJMZ: I believe on the decision to punish or censure or reprimand ang magdedesisyunan niyan kasi ang body dito sa plenary. That could be majority of those who have attend.

Q: So, sir doon pa lang magiging madugo na siguro ang debate?

SJMZ: Doon pa lang magiging madugo ang debate. Pero on terms of punishing a fellow senator, I don't think na dapat bumaba naman ng 12 votes iyon.

Q: Sir kin-consult iyong legal department ng Senate?

SJMZ: Yes we're still awaiting for the report. They are giving us a report this afternoon kaya medyo natagalan kaya hindi po namin nadesisyunan ang botohan dahil inaayos pa natin itong fundamental legal question is what is the required vote now.

Q: Sabi ni Sen. Alan paiba-iba daw ng stand iyong majority, parang nagdadagdag bawas na daw doon pa lang sa botohan?

SJMZ: Hindi naman. My stand has been that its majority of the members of the committee of the whole. So, if it's a membership of the committee of the whole that is 23 senators, that is 12. That was always been my stand. I think Sen. Enrile also shares the same stand, but there are opposing views to this particular issue. But iyon nga e, gray nga siya. Ang problema kasi ng ating Constitution, ng ating Saligang Batas ay hindi po specific pagdating sa censure and reprimand. Specific sila sa suspension and expulsion.

Q: Iyong boto ba ni Ping sir pede ba tawag lang?

SJMZ: Hindi puwede. Kailangan lahat ng senador na gustong bomoto dito sa particular issue na ito kailangan present po sila sa plenary. That is quorum requirement under the Constitution that to be able to do business for the day in the Senate you must be present to constitute a quorum.

Q: Ano naman kaya ang nakalinya mamaya?

SJMZ: Marami. Hopefully ma-bicam na namin iyong Immigration Act. Third reading marami tayong mga local bills. Meron pa tayong mga universities and state colleges pending for third reading. Pero karamihan ng mga third reading today mga request ng congressmen at local government.

Q: Sir anong status ba ni Sen. Ping? Ilang araw na siyang absent or may info ba kayo sa ganoon? Nagtatago ba siya sir?

SJMZ: Ah ikaw ba Ruth? bakit nakatago ka sa likod ko? Ah hindi ko alam. I have no clue where he is. I have no clue what's the reason ...

Q: Kapag ganoon ba wala naman ano iyon kapag absent ng matagal? Censure? Pagnagtatago? Hindi ba sir nagkaroon ng kasunduan noon na bawal mag-leave? Kasi may memo kayo na mag-a-attend ng session?

SJMZ: Mahirap sagutin iyan.

Q: labo-labo question ...

SJMZ: Yeah bukas. I think hindi na kailangan ng extension. I think we can achieve what we'd like to achieve tomorrow. Ang importante lang may proper decorum. Walang vulgar remarks na magiging katawa-tawa po kami sa mata ng publiko. And I think they all agree. Lahat ng senador ay pumapayag na iyong debate limitahan natin sa parliamentary procedures at parliamentary language para sa ganoon ay hindi matamaan ang imahe ng senado. Dahil nakita naman po natin last week dahil sa nangyari medyo binugbog ng binugbog po kami ng publiko na wala na po kaming ginawa kundi makipag-away sa ating mga kasamahan dito sa Senado. Pero mahirap naman kung we will leave it hanging kasi gagawin po itong campaign issue sa kanya. So, i think the best remedy for that is tapusin na natin itong debate. Let's close it once and for all, and come out with the vote. If there is enough vote then so be it that is the will of the Senate. Kung wala namang boto to carry over the committee report then that is vindication for Sen. Villar.

Q: At this point kaya ng majority na magkaroon ng at least 12 votes?

SJMZ: That I cannot say. Siyempre hindi natin alam kung sinong sisipot, kung ano iyong boto nila. Yes ba? Abstain, hindi natin alam.

Q: Pero ikaw Sir may desisyon ka na kung anong boto mo? Decided ka na?

SJMZ: I will decide by tomorrow. I'm still listening to the debates, during the debate. Mahirap magbigay ng desisyon ngayon baka madaming tatawag sa akin.

On 5,000 cell phone jammers:

Q: Other issues naman. Sabi ni James Jimenez, meron daw 5,000 units of cell phone jammers ...

SJMZ: Well if there are kailangan ma-monitor nila kung saan pumunta iyong 5,000 units na jammers na iyan. Baka kailangan i-rehistro iyon. Kung may pumasok talaga irehistro para malaman kung sinong may hawak nito. Inaasahan po natin ang Comelec nag magsagawa ng order on that particular issue dahil kung hindi talagang gagamitin po nila iyan to disrupt the elections of 2010. Pero common naman iyon cell phone, alam ko iyong mga cell phone jammer na iyan hindi mo magamit sa mga simbahan o mga bangko. Let us see the end recipient nitong mga cell phone jammers. Pero kung ano man dapat magpalabas na ang Comelec ng isang order, ordering the NPC na iparehistro ang lahat ng cell phone jammers na ito or kung puwede ipa-recall at i-release na lang ito after the elections.

Q: Mas malapit ba iyon sa hackers iyong jammers?

SJMZ: Yeah. Well made-delay lang ang transmission ng ating results. Hindi naman mawawala iyong resulta ng eleksyon. For example doon sa presinto hindi naman mawawala iyong boto ng presintong iyon pero iyon nga lang iyong quick count transmission doon sa main office at sa provincial office made-delay. And that could be a source of a problem because siyempre kapag dala mo ng machine doon sa particular provincial office puwedeng i-ballot box snatching pa rin iyon kasi hindi pa natin nata-transmit iyong findings. That is what we need to protect the sanctity of that computerize result. Let me say this again the Comelec should issue already an order to the NTC to register these 5,000 cell phone jammers or temporary recall the units and release it after the elections.

Q: Meron daw anti-jammers?

SJMZ: Wala daw. The NTC was interviewed kanina. They can detect where it is but they cannot stop. Kung magaling magtago. Kung isang daan iyong tao doon sa lugar talagang ibo- body search mo iyan lahat-lahat.

Q: Hindi kaya reason lang iyan ng Smartmatic dahil palpak iyong mga machines?

SJMZ: Hindi naman siguro. But it's a consideration that we have to think about. Dahil cell phone jammers will jam any reception and any transmission outside. So, talagang kailangan i- recall iyan. Kasi iyong NTC yata nagbigay po ng order na ipapasok ng 5,000 cell phone jammers. So since they were the ones who gave the order or the approval, they can also be the ones to recall it. I-recall muna.
