TRANSCRIPT OF POST-POLL FRAUD HEARING PRESS BRIEFING OF SENATOR ALAN PETER CAYETANO

(Comparison of Hello Garci tapes and statements of witnesses needed)

I think the important thing about the witnesses who flip flop is if they're the only witness, then there can be a question to the credibility or to the evidence regarding a certain event. But when there are many other factors to prove their credibility, the evidence becomes more valid.

That's why I want a comparison of the events that took place based on the Hello Garci tapes and statements of the other witnesses. And if you look at it, so far, the evidence is really pointing to massive orchestrated fraud in the 2004 election.

Ang point, during the time of Chairman Abalos, all the way to Chairman Brillantes, napo-promote pa sila.

Some assistants worked themselves up to the director levels now.

Before this hearing, the COMELEC commissioners and Chairman Brillantes were always saying hindi nila maalis sapagkat wala namang ebidensya against them. But you can see that by simply asking them the questions, may ebidensya na.

('Institutional Reform in Comelec: Not possible if we have the same people')

Kahit anong reporma, kahit P7 billion-P10 billion-next year P7 billion ang allotment sa COMELEC para sa automationif you have the same people, there can be no reform. On the other hand, if they're innocent, they should be given a chance to testify and clear their names.

But right now, we're not only holding people accountable for 2004 and 2007 and even 2010 elections. We're talking about the 2013 and 2016.

Pwedeng may rehash of some factual matters. Walang nakasuhan. Baligtad pa nga ang nangyari. 'Yung mga nabanggit, na-promote nang na-promote.

It's not a rehash in the sense na walang double jeopardy, walang hearing na nangyari, walang free investigation dahil noong nasa House kami, 'yung majority, gustong protektahan si GMA.

Rafanan, baligtad.

'Yung parts of the Hello Garci, tinitingnan pa namin lahat ito. But, for example, may part doon na may kausap si Commissioner Garcillano na kapag hindi pumunta 'yan baka kunin natin o kunin natin ang pamilya. What area were they talking about? Sino ang taong kausap nila? Marami tayong babalikan dito.

For example, the Mayuga Report was not available to us during that time. Nabanggit ang pangalan ni Dir. Sumalipao, pero nakita n'yo kanina that when confronted kung may meeting ba, inamin niya na nag-goo-good time siya sa Cagayan de Oro, pero nakalimutan na nga daw niya whether or not nakipag-meeting siya kay Gen. Gudani at kay Com. Garcillano.

Basically, what I like about this investigation at 'yung ginawa ng dalawang senator na chair, bottom up ito. Maaaring hindi siya kasing-exciting in the sense na hindi 'yung main personalities, hindi si FG, hindi si Commissioner Garcillano, hindi si Chairman Abalos ang nandito right now, but then, we're gathering the evidence from the ground, going up. By the time na dumating na kailangan nang ipatawag si Commissioner Garcillano, we'll have more than enough evidence.

('Take active role in filing perjury cases')

Dito sa imbestigasyon na ito, we can actually put people behind bars if the DOJ will take an active role in filing perjury cases or giving false testimony doon sa mga magsisinungaling sa senado.

In terms of legislation, kargo namin 'yon. But in terms of ma-convict o makasuhan, kargo ng Ombudsman, DOJ, at ng mga korte 'yon.

But I'm really hoping and praying that this time around, makakasuhan na. That's why si Sen. Pimentel took a step of faith by filing a criminal complaint.
