"JPE's recent actions have set a bad precedent on how the integrity
and independence of the Senate is upheld"

Cayetano pushes for an independent audit on Senate Funds

Reporter: Is there any reason for Senate President Enrile's orders of recalling some of your staff?

ASC: Alam mo six years na akong senador, usually kapag nageexpire yung kontrata nung staff na naka-detail sa isang senador ay pinapa-renew lang yon o hindi nire-recall basta iyon o kaya't tatawagan man lang sila nung Secretariat to inform them of the situation. Sa nangyari ngayon, hindi mo matatanggal sa akin na i-link ito sa kasalukuyang isyu kay Senate President.

When I became Senate Minority Leader at nakita kong hindi masyadong nagustuhan nung Senate President iyon; hindi lang ako umimik noon pero pati yung opisina ng Minority Leader tinanggal. Dalawa yung opisina ng Senate Minority Leader ever since pero binigay sa iba yung isang office.

This November, noong pinag-uusapan yung budget nagumpisa na yan kasi gustong tanggalan ni SP ng budget o bawasan ng budget yung committee ni Sen Trillanes. Natural kailangan naming depensahan dahil nasa Minority siya at ang pondo naman ng Committee hindi para sa Chairman yan -kung hindi para yan sa buong Committee.

Sa akin naman, sanay na sanay naman ako na tinatanggalan ng pondo at staff dahil ginawa na sa amin ni (former President Gloria Macapagal Arroyo) GMA ito noong Congressman ako. Hindi magbabago ang aming prinsipyo o ang aming stand sa issues just because ginigipit kami.

Kaya lang naman ako nagsasalita dahil yung independence at yung integrity ng Senado apektado na dito. Pupwede ba naman yon na kapag malapit ka sa Senate President or gusto niya yung sinasabi mo ay mas malaki ang pondo mo o yung staff mo, tapos ay pagbibigyan ka pero kapag hindi kayo okay ay ganito ang mangyayari - maaapektuhan pati ang operating budget mo.

Although nagpapaliwanag sila kahapon, ang mungkahi ko lang naman ay kung yun lang ang dahilan na nag-expire na kontrata ng mga staff, bakit hindi nila ni-renew. Halos lahat naman ng opisina sa Senate may naka-detail na staff from the Office of the Secretary dahil ito yung mga nagiging technical experts over time.

"Power to influence leadership change lies with the Majority"

Usually, may common courtesy among senators. Siguro nababali-balitaan yung sinasabing pagpalit ng leadership sa senate but I've always denied that there's such a move. Katulad noon, bilang nasa minority kami, wala kami sa posisyon na magpalit ng leader dahil nasa members ng majority ang kakayanan na iyun [kung gusto nila o hindi].

Right now wala kaming problema sa minority. Titiisin nalang namin na tinanggal yung mga pondo at tinanggal yung mga staff. Ang question ko ay para sa majority. Paano kapag kayo naman ang nagkasagutan o iba ang prinsipyo ninyo sa Senate President?

Kung sinuman ang magiging president [Si Senator Enrile or sa future kung sinuman] payag ba kayo na ganyan ang patakaran namangyayari? Akala ko ba tuwid na daan tayo ngayon eh yun pala kung ano sistema ni GMA, ganun pa rin pala ang sistema ngayon.

Reporter: Yung away ni Trillanes at Enrile malinaw, Miriam vs Enrile malinaw din pero kayo ano ba yung tingin ninyo na nag-trigger, bakit biglang pinag-initan din kayo?

ASC: Kasi dati na namang ugali pa ni Senate President yon na ayaw niya na nagkakasalubungan kayo sa issue. Kung napansin mo kahit nung Impeachment, pag ako tumayo, mas mahigpit siya sa oras at nagkakasagutan kami. It's just his old habits and his approach to someone who is part of the younger generation compare to his.

I tried to be very respectful pero ano magagawa naming kung iba yung prinsipyo naming sa ibang mga issues. Nag-flare up ito noong RH Bill dahil nga yung kapatid ko, si Sen. Pia ang nagsulong nito, tapos pagkatapos may strategy sila na idelay at huwag muna i-calendar eh talagang even sa mga caucus kahit wala sa topic, bini-bring up ni Sen Pia yon na kailan ba i-schedule ganyan so siguro parang napahiya din na napasa to, tapos hindi siya sinuportahan ng mga myembro pagdating dun sa mga amendments dahil ilan ang pinropose niya na talo parati sa floor.

"Carrot and stick tactics"

Kahit may ganitong pangyayari, parati namang pinapaliwanag sa kaniya na walang personalan pagdating sa pagkakaiba ng maninindigan. Kung may bill ako na talo sa botohan, tatanggapin ko. I understand that the other senators are not voting against me; they are voting against the measure.

Hindi naman batayan o hindi naman sukatan ang suporta sa Senate President kung nagkakaisa kayo palagi sa botohan o paninindigan sa mga bills. Somehow siguro gusto niya magpakita ng kanyang awtoridad kasi diba dati siyang martial law administrator. He's used to getting what he wants. "Carrot and the stick tactics" kasi ang uso noon.

Iyon ang ginawa ni GMA kaya sabi ko usually sa Senate, nirerespeto yung opinion ng bawat isa. Hindi pwedeng carrot and the stick tactic.

"For the sake of transparency, I am for an independent Audit of Senate Funds"

Ang aking proposal nga to get to the bottom of this kasi nakakahiya naman sa dami ng problema ng bansa, pondo sa Senado pa ang pinag-uusapan. It would be better if instead of letting the COA do it or letting the COA do an independent /parallel investigation, why don't we get a private and reputable auditing firm to do an independent audit on the Senate Funds?

Reporter: Dati naman, wala naman problema sa distribution ng savings ngayon lang nagkaroon dahil sa hindi pantay ang hatian.

Well, tatlo yung issue kasi: (1) Dati binibigay yan kapag November para magagamit ng December kasi minsan maraming activities sa December at saka lately, maraming kalamidad so, syempre extra funds can always be used to aid the typhoon victims; (2) Walang cash gifts dati. It's always MOOE funds being disbursed. No such thing as savings from the Senate President's office being disbursed based on the SP's discretion; (3) Ngayon, pinapalabas niya na discretion niya.

It doesn't matter much that I was one of those who got less. Ako kahit malaki yung binigay sa akin at mas konti yung binigay sa iba, aangal din ako. The point is, it was never the discretion of the Senate President on how these operating funds should be distributed to the Senators.

"SP discretion sets a bad precedent"

We act as a group being a collegial body when it comes to funds. The SP is just there to implement when it comes to these administrative matters. It is the first time in the history of Senate that the SP had discretion in disbursing these operating funds. This will set a bad president.

If we allow this to happen, favoritism may be in play and this discretion can be used to influence the supposedly independent minds of the Senators. Hindi ko sinasabi na makukuha ang mga senador doon pero kawawa naman yung mga constituents ng mga opisina kung maiimpluwensyahan ng pulitika ang panininindigan ng kanilang mga representante.

Iyan ang sinubukang gawin ni GMA dati. Kung hindi makuha sa pagbaba ng mga pondo, tatanggalan ng security; kung hindi pa rin makuha, babawasan ka ng ibang pondo matapos ay tatakutin ka naman. Ang problema, sanay na kami dyan. Ang tanong, sa majority, kayo ba sanay kayo? gusto niyo ba ganyan mangyari sa inyo?

Reporter: Miriam and Trillanes being vocal calling for a change in Senate leadership... your take?

I've always said it is for the majority to decide that. Sa minority kami eh. The mere fact that we are in the minority, it implies hindi kami pabor sa kung sino ang nakaupo. But I've always said that every Senate President does a good job but has a certain style. It really depends on the majority but for me, bigger than the issue of leadership, the bigger issue here is the integrity and independence of the Senate.

Kaya nga nasira yung sistema sa House of Representative dati noong nagkaipitan sa pork barrel, nakakalungkot na ngayon nangyayari rin ito sa Senado.
