Opening remarks of Senator Joel Villanueva

Magandang umaga po sa inyong lahat, at salamat sa inyong pagdalo.

Aaminin ko po, naniniwala ako sa kasabihang, "bihirang masilayan, agad nakakalimutan" na sa wikang Ingles ay, "out of sight, out of mind". Sana nga lang po ay masasabi ko ito tungkol sa isyu ng pagdagsa ng mga illegal foreign worker sa Pilipinas.

Dalawang taon na po - December 2016 nang tayo'y nagsimula - 2019 na po at andito pa rin tayo. Walang "nag-move on", sa halip ay lalong sumidhi at umigting ang lahat. Araw-araw, pulu-pulutong ang mga dayuhang Chinese na nakikita natin. Imposibleng makalimutan, at hindi maaaring tayo'y magbulag-bulagan sa isyung ito.

Recently, may insidente pa po ng pananaboy ng taho sa ating pulis. Iyon pong Chinese national na nagsaboy ng taho [na si Ms. Jiale Zhang], walong taon na raw po dito sa Pilipinas. Ano po ba ang hawak na visa ng taong 'yan? Isipin n'yo po, pinatuloy mo na - for 8 years, nilapastangan ka pa.

Totoo pong hindi natin dapat basta na lamang palampasin ang sabihin na nating maliit na isyu lang naman ng pananaboy ng taho. Gaano pa kaya ang maraming mga Chinese nationals na involved sa iba pang malalalang krimen, o ang daan-daang libong trabahong ninanakaw sa ating mga kababayan ng mga illegal Chinese workers.

Ang lahat po ng ito ay nag-ugat sa mga "petiks" na patakaran sa pagbibigay ng SWP ng walang kaakibat na Alien Employment Permit. Kung ganyan ang sistema, talagang magkakaroon po ng influx ng illegal foreign workers sa bansa.

Ang problema hindi lang kasi "petiks", may "lagayan" din udyok ng mga "fast lane" sa mga satellite office ng Bureu of Immigration tulad ng sa SM Aura. Dagdag na bayad na P5,000, walang resibo, labas na ang visa in one day!

I think the Bureau of Immigration should identify and name the persons responsible for allowing the proliferation of foreign workers without the proper determination required by law. I believe they should be charged with violating the Anti-Graft and Corrupt Practices Act for soliciting favors as a function of their office.

May problema din po tayo sa DOLE. Mukhang "petiks" din ang ginagawa nilang Labor Market Test.

If you believe that compliance with the public posting of the job being applied for by the foreign national already constitutes compliance with your duty to execute the labor market test, then, you are also accountable to the influx of illegal foreign workers.

Sana'y nagtutulungan dito ang BI at ang DOLE. Yet, apparently, they lack coordination. Kahit data sharing man lang, mukhang wala po sila.

All we need is an inter-agency method of checks and balances to avoid the current problem that we face right now. This is the reason why we put a special provision in the 2019 budget that mandates the BI to coordinate with the DOLE pertaining to the entry of foreign workers.

Sagrado po kasi sa atin ang Section 12, Article 12 of the Constitution that guarantees preference to Filipino labor. Sa anumang trabaho, Pilipino muna bago ang dayuhan. Ito po sana ang pagbatayan, paghugutan, at panindigan nating lahat.

Ngayon, ang palagi ko pong naririnig, POGO workers daw karamihan ang nabigyan ng SWP dahil walang maraming Pilipino ang marunong sa Mandarin.

Para po sana hindi tayo umabot sa ganito, PAGCOR should have been more thorough in determining the scale of operations of foreign and local corporations that want to engage in POGOs or their respective service providers.

Bakit mukhang ang luwag din natin sa mga POGOs; at sa totoo lang po, hindi ko rin maunawaan kung bakit idadagdag pa natin ang mga ito sa masalimuot nang usapin ng pagsusugal at mga pasugalan sa bansa natin, legal man o illegal?

Issue po ito ng regulation...but regulating these POGO companies does not begin and end with registration. PAGCOR is responsible for gaming operations, and you are designated by the State to ensure compliance with our laws concerning gaming operations. Kasama rin po dapat kayo sa pag-examine kung sa mga Pilipino napupunta ang mga trabaho sa POGO.

Resulta: kaliwa't kanan po ang mga pag-aresto sa mga illegal Chinese workers. Dahil nariyan na po ang problema, I believe, there should be an Inter-Agency Task Force on Foreign Workers comprised of the PNP, the NBI, the DOLE and the BI. Kasi po sa ngayon, kanya-kanya po kayo ng galaw.

Finally, ito raw pong pagdagsa ng mga Chinese workers maging sa construction ay dahil wala nang natirang skilled workers in the country. Ang tono po parang kanta ng kaibigan nating si Gloc-9 na "Walang Natira". Wala na daw pong natirang skilled workers kasi nag-aabroad sila. Kaya napunta na lang sa mga Chinese workers pati trabaho sa construction dito sa Pilipinas.

Ang totoo po, majority of TESDA graduates or 81.82% work within their province and those who chose to work outside the country, iyong mga nag-abroad, 2.52% lang. So, halos tatlo lamang po kada isandaang TESDA graduate ang nag-aabroad .

Last year, ilan po ang graduates ng construction related qualifications ng TESDA? Nasa 234,534 po. Iyong mga nag-aabroad, 2.52% lang. So, hindi po totoong walang natira, napakarami pong natitira.

TESDA even alloted 25% of the Training for Work Scholarship Program (TWSP) budget for skills training on construction-related qualifications to boost enrollees in 62 construction related training regulations.

Bottomline: may number po tayo, may sapat na skilled workers sa Pilipinas. Kaya ang tanong, bakit ipinamimigay sa mga dayuhan ang mga trabaho? Bakit hinahayaan nating manakaw sa ating mga kababayan ang mga oportunidad na ito? Para kanino po ba talaga ang trabahong dala sa construction industry ng Build, Build, Build Program - sa mga Filipino workers o para sa mga Chinese workers?

I hope this will be our last hearing on the issue and we look forward to a committee report containing our recommendations to finally put an end to the influx of illegal foreign workers in this beloved country of ours.
